SC: Delhi LG to
oversee key areas
rest under State
May 11, a five-judge
Constitution bench led by
Chief Justice of India (CJI)
DY Chandrachud ruled
unanimously that the
Centre has power over
three key subjects which
are order, police and land
and gave the State
Government of Delhi the
power to create posts,
appoint officials and
transfer them over other
services.
The case related to
transfers and postings of
civil servants in Delhi. The
bench was unable to
agree with Justice
Bhushan’s 2019 split
judgment where he said
that the NCT of Delhi has
no power over services.
Article 239 AA clarifies
that Parliament has the
power to legislate on any
subject of NCTD in any of
the three lists. In case of
conflict the law by the
Assembly will be void.
However, reasonable
restrictions were read into
the clause to allow power
to elected officials.
