ballistic missile in a user-
trial conducted by the
Strategic Forces
Command (SFC) that
deploys India's nuclear
arsenal. The Agni V can

tested in 1998.
Until now, the 3,500 km
Agni III, served as the
backbone of the Indian
nuclear deterrent against
China. It could target all

draft Act by Feb 2022.

Nov 2, the Pakistan
government announced
that it has reached a
ceasefire agreement
with the outlawed
Islamist party Tehreek-i-
Labbaik Pakistan (TLP).
The TLP had mobilized
tens of thousands of
protestors to stage rally
moving from Lahore to
Islamabad demanding
that the Pakistan
government release
their leader Saad Rizvi,
who was arrested last
year for demonstrations
against France after a
French magazine
published caricatures of
Prophet Muhammad,
and expel the French
ambassador. Oct 30, it
emerged that TLP
members had used sub-
machine guns (SMGs)
against policemen
during anti-government
protests. Footage,
showed men firing 80
rounds of SMGs. Seven
policemen were killed
and several injured. The
terms of agreement
between the TLP and
government have not
been revealed as yet.

then. By 2030, it also
plans to reduce carbon
emissions by 1 billion
tonnes and the carbon
intensity of its economy
by 45%. It asked to be
made part of the NSG to
help meet its goals.

Oct 31, the Mazagon
Dock Limited (MDL) has
delivered the first of
four stealth guided-
missile destroyers, INS
Visakhapatnam, under
project-15B, to the
Indian navy. The 164
meters long destroyer is
among the largest made
in India. It has a
displacement of over
7,500 tons, can
accommodate a crew of
312 and has an
endurance capacity of
4,000 nautical miles
allowing it to carry out a
typical 42 day mission
with extended time in
remote areas. Onboard
are 127 mm guns and
two helicopters. Its
radar footprint is
smaller than its Kolkata
class predecessors. It
has 72% indigenous
content. The remaining
3 destroyers will be
commissioned 2022
onwards.

Navy gets a

laywer for bribing a CBI
officer. Then a day ago
CBI arrested a
middleman in a related
police transfer
corruption case.
Deshmukh had failed to
show up for five ED
summons and had
moved High Court (HC)
to have the summons
quashed. His arrest
follows HC’s rejecting
the petition.

Act, NDPS Act, Customs
Act etc. The recent
extension of
jurisdiction of BSF has
been made keeping
this evolution in mind.
There is no secret that
the State police is
hopelessly politicised
and under pressure
too. In many States,
where two parties
come in power
alternately, the police
force is divided with
their respective
loyalties to one or the
other party. This
explains why there is
an en masse transfer of
police officials after a
new government is
sworn in a State.
This is not the case with
the Central
Government. The
Chiefs of Central Police
Organisations are not
changed after the
coming of a new
government at Centre.
More or less, central
police agencies are
independent except the
‘caged parrotCBI
which has been used
multiple times as a tool
in the hands of the
party in power at
Centre. There are also
serious allegation of
bias against the
agencies like Income
Tax and ED probing
economic offences of
the people owing
allegiance to
opposition parties. In
spite of these
aberrations, central
forces are seen to be
impartial and even
relied upon to ensure
the peaceful conduct
of General Elections.
The recent times have
witnessed serious
confrontation between
the central police
agencies like CBI, NIA,
NCB , CRPF and BSF on
one side and the
States police on the
other in States where
the party other than
the one in the Centre is
in Government. The
central police officers
are not accorded any
courtesy, not
cooperated with and
sometimes even
harassed by State
police. This has
reached a point of
absurdity now.
Recently
Maharashtra Police
filed a case against
the Director of CBI
and summoned him.
The NCB officials
handling Aryan Khan
Drug case are alleging
that they are being
followed by
Maharashtra Police
personnel. Every
army movement in
West Bengal is break
down of federal
structure as per the
statement of its Chief
Minister. CRPF cover
is required for Central
Police officials to
carry out its duty in
West Bengal.
It does not end here.
The States police
indulge in full scale
war amongst
themselves too.
During the lockdown
1, the Rajasthan and
Haryana Police fought
at the Dharuheda
border. Fortunately
there was no
casualty. Recently
there was an armed
conflict between
Assam and Mizoram
Police in which five
Assam police
personnel were killed.
This brings us to the
main issue. Under
these circumstances,
can the matters of
national security be
left in the hands of
States? The answer is
a big NO. This is not
negotiable. So if an
additional power to
the organisation like
BSF is given, it is a
welcome step. The BSF
is the pride of the
nation and our first
line of defence. They
serve the country in
the condition that
politicians can’t even
imagine. If extending
the power of BSF for
its operational
efficiency is an attack
on the States’
misunderstood
federalism, then let it
be so. There can be no
compromise on this
matter whatsoever,
irrespective of what
the political clowns in
the States say.

The bigger issue here
is the division of the
policing power of
States and Centre. This
has a British legacy
wherein the Princely
States were allowed to
enjoy the day to day
authority on law and
order within their
States and British were
more interested in the
revenue and trade.
After Independence,
continuing with Govt
of India Act 1935, the
States were allowed
the power of
maintaining law and
order. This was to be
carried on as per the
provisions of CrPC and
IPC. In course of time,
new challenges to
national security
emerged leading to
the enactment of
Special Acts. It
necessitated certain
offences to be
investigated by the
central agencies. Many
of these Special Acts
do not strictly follow
CrPC and have special
provisions in the Act
Itself. Accordingly, the
central agencies were
invested with extra

hope that some day
or other, as we
struggle through the
paths of life, there
will come a time
when we shall
become perfectly
unselfish; and the
moment we attain
to that, all our
powers will be
concentrated, and
the knowledge
which is ours will be
manifest.

Punjab just before the
State election?
The problem emanates
from the mistaken
belief that India is a
true federal country. As
per the Constitutional
scheme of the things,
India is an Union of
States that has some
federal features like
bicameralism, division
of power through three
i.e. Union, State and
Concurrent lists of
subjects for making
laws. India is not a
‘coming together
federation’ like USA
but a ‘holding together
federation’ like Spain.
Most of the features of
the Constitution
indicate an unitary
nature of the country.
The Centre has an
overriding power in the
Constitution to make
any law under
Concurrent List and
enforce it whether the
States like it or not.
These facts are known
at the entry level of
politics in India. Still we
have Chief Ministers
calling every action of
Centre as an attack on
federalism.

The Government of
India in the exercise of
the powers conferred
by sub-section (1) of
section 129 of the
Border Security Force
Act, 1948 (47 of 1968),
has extended BSF’s
jurisdiction to 50 km in
Rajasthan, West Bengal,
Assam and Punjab
where earlier it was 15
km. Some States like
Punjab are seeing this
as an attack on
federalism. A similar or
even harsher tirade is
likely to emerge from
West Bengal.
It is ridiculous to think
that when BSF all along
had a jurisdiction of 15
km for its operations in
Punjab, it was fine.
Once extended to 50
km, it is hurting
federalism. Does
federalism mean that
the border guarding
agencies is not given
adequate power? Is it
just a desperate
attempt to woo the
secessionist forces in
BSF gets extended powers to search in border states. Why the fuss?
