UP files FIR against Twitter and 7 others for
stoking communal enmity with fake news

deliberately spreading
fake news to heighten
communal enmity.
Despite being
influential members of
the society some were
repeat offenders the
FIR added.
The Gaziabad police
investigation and a
Republic TV sting reveal
that on June 5, an
elderly man, Abdul
Samad Saifi, was
thrashed mercilessly
and had his beard
forcibly chopped off by
a group of six men
comprising Muslims
and Hindus, over the
dissatisfaction with an
occult amulet that Saifi
had supplied the main
accused, Parvez, a
Muslim. A video of the
incident was shot
without an audio track.
June 7, Samajwadi
Party (SP) leader
Ummed Pahalwan after
meeting Saifi,
fabricated a communal
narrative on Facebook
that a group of Hindu
men thrashed Saifi for
refusing to chant ‘Jai
Shri Ram’ and ‘Vande
Matram’. Saifi also
upheld Pahalwan’s
version. On June 13, a
mute video of the
incident was first
tweeted by Harun Khan
who is reportedly in
Saudi Arabia.
But the Gaziabad police
debunked the claim
after it arrested 10 of
the accused within a
week, including
Pahalwan, and found
that many of Saifi’s
assailants were

Assam already restricts
people with more than

approval ratings
reported that PM Modi
continues to have the
highest approval ratings
among world leaders
from 13 countries
including the US, UK,
Japan, Australia, France,

Brazil. PM Modi has
enjoyed this pole
position in an almost
unbroken streak since
June last year.
His approval rating at
66% was ahead of
German chancellor
Angela Merkel’s and US
president Joe Biden’s
53% each, and UK PM
Boris Johnson ‘s 44%.

Calcutta HC confirms NHRC probe of post poll violence

seditious toolkit, which
surfaced on social media
in May, belonged to the
Congress party.
The HC, orders said, “The
averments of the FIR
reflect that by the tweet
of the petitioner,
Congress men are
aggravated which clearly
indicates that no public
peace or tranquility is
being adversely affected
and it is purely political
rivalry between two
political parties ”. It went
on, “prima facie, no case
is made out against the
petitioner and criminal
proceedings is manifestly
attended against the
petitioner with malafides
or with political grudge".
The interim order
granting relief also asked
the state government to
file a reply within 3
weeks.

On June 18, a 5-judge
bench heard a number
of PILs alleging post-
poll violence. Taking
note a report
submitted by the
Member Secretary
Legal Services which
said 3,243 persons
were affected till June
10, the bench ordered
NHRC to set up a panel
to visit affected areas,
provide details of the
violence, offenders
and errant officers and
suggest measures to
restore confidence.

Jun 15, acting on an
intelligence tip off the
Kerala forest
department raided a
cashew plantation in
Kollam district and
discovered 2 gelatin
sticks, 4 detonators,
batteries, wires and
adhesives. The PFI is
suspected to have
conducted clandestine
weapons training here.
The Income Tax (IT)
department swiftly
cancelled PFI’s 80G
registration. 80G is
used to incentivize
donors to contribute to
a charitable
organization. Individuals
can claim tax deduction
on donation made.
IT accused PFI of
destroying brotherhood
among communities.
The ED and NIA are
investigating PFI for
money laundering and
engaging in unlawful
activities. Last year, UP
CM had asked for a ban
PFI as its cadres became
violent during anti-CAA
protests

announced it has

construction of a
display manufacturing
plant in Noida, UP,

out of China.
Samsung praised UP’s

India, Samsung had

December, that it
would invest ₹4,825
crore. The plant will
engage 1,500
employees and create
indirect employment.
It will be used for the

of post poll violence in
West Bengal. The
Calcutta HC refused
the Mamata
government’s request
to recall its order.

However, the insidious
use of Twitter to
amplify a fake narrative
starting June 13 poses a
serious challenge to
Indian law enforcement
agencies. The Republic
TV investigation
identified 8 prominent
Twitter handles which
spread the fake
narrative and garnered
44 thousand likes and
15 thousand retweets
within 24 hours, which
means potentially
millions of views. The
Gaziabad police replied
individually to each
handle to put out the
truth but with few
followers on Twitter,
their rebuttal was seen
by only a few hundred
people. Twitter handles
abroad were used to
seed, or act as force
multipliers in spreading,
fake narratives. AIMIM
chief Owaisi lashed out
at Hindutva ideology,
holding it responsible
for the incident. Rahul
Gandhi also peddled the
fictional narrative.
The UP government has
invoked sections 34
(common intention), 120-
B (criminal conspiracy),
153 (provocation with
intent to cause riot), 153-
A (promoting enmity on
grounds of religion), 295-
A (deliberate act to
outrage religious feelings)
and 505 (statements
conducing to public
mischief) of the IPC in its
FIR. It has accused Twitter
of failing to take down
tweets that spread
misinformation. This is
the first case against
Twitter where it has been
held liable for third party
content after it lost its
information intermediary
status following its
breach of IT Rules. June
17, the police also sent
Twitter India MD,
Maheshwari a notice to
join investigations within
a week.

The Muslim population
in Assam has grown

charge in 2017, in an
interview to
IndiaTVNews he said,
“Now police is
registering all FIRs
100 per cent. We are
taking it as a
challenge and aim to
eliminate crime. It
appears we will soon
catch big fish.” He

animals that have
been halted by our
government, are now
unemployed. For
employment, they
may work as

Police officers have
been told that there
will be zero-tolerance
towards crime and no
compromise on law
and order.
This has had
bolstered police
confidence. In
December 2019,
when an ex-UP chief
minister tweeted that
the UP police should
take a page from the
Hyderabad police on
an encounter, the UP
police retorted on
Twitter, that it does
not need any. The
tweet went on,
“Figures speak for
themselves, and
‘jungle raj’ is a thing
of the past”. It added
that in last 2 years,
103 criminals were
killed and 1,859 were
injured in
engagement by
police. They also
added that 17,745
criminals surrendered
or cancelled their
own bails to go to jail
during this period.
Civil society has
benefited as a
consequence.
Earlier this month, at
a Home department,
meeting he
remarked, “Statistics
are not a parameter
for crime control. The
actual standard is the
faith of people, and
we have to prove
ourselves on this
front.”
Crime statistics can
be difficult to
interpret. An
increase in crimes
reported may not
necessarily mean a
deteriorating law and
order situation. It
might reflect
increased faith of
citizens in the policing
and thus an increased
reporting. Similarly,
an increase in crime
may be a
consequence of
circumstances
prevailing in a society
independent of the
state of policing. The
2019 ‘Crime in India’
report of the National
Crime Records
Bureau (NCRB)
cautions against both
these
misinterpretations.
Reported crimes have
to be read in the
context of the size of
the population to be
policed. The rate of
crime per lac of
population for UP at
278 per lac of
population is well
below the country’s
average at 385. This
was low even in 2016.
Yogi Adityanath, is
however, seen to be
tough on anti-social
elements, and seems
to enjoy the support
of people as far as
tackling crime is
concerned. An IANS-
C Voter survey that
polled more than
15,700 people from
UP between March 8
and March 15,2021
showed that the
majority of those
surveyed, 53% , felt
safe under the Yogi
government. 55%
felt that the
Adityanath headed
regime took “strict
actions” against the
Atiq Ahmad and
Mukhtar Ansari
gangs. And more
than half also added
that the CM has been
able to control his
ministers.
The government’s
action against
established criminal
syndicates has had a
salutary effect of
almost dismantling
the crime ecosystem.
It has prepared a list
of 33 dons in UP all of
whom are in prison
now. The police are
surveying illegal
property amassed by
the mafia. The state
Gangsters and Anti-
Social Activities
(Prevention) Act,
1986, was amended
in February this year
to allow even deputy
commissioner-rank
officers to order the
attachment of alleged
gangster property.
Over ₹1,000 crore
worth of properties
acquired by the
criminal mafia have
either been
demolished or
confiscated. More
than half belonged to
the 33 big dons. MP
Atiq Ahmad tops this
list, with his assets
worth ₹ 203 crore
having been
demolished as of
now. He is followed
by Mukhtar Ansari
and his aides, who
have had property
worth ₹ 179 crore
seized or demolished.
At the end of 4 years
of the Yogi
government
published a booklet

Under Yogi
Adityanath’s
leadership Uttar
Pradesh (UP), the
most populous Indian
state with over 24
crore people, not
only stemmed the
spread of the Corona
pandemic effectively
it also doubled its
GDP between 2017
and 2021. The state
with about 17% of
the country’s
population, suffered
only 6% of the Covid
fatalities.
Additionally
administrative
excellence propelled
the state GDP from
about ₹ 11 lac crore to
22 lac crore in this
time, making it the
second largest state
by GDP in the country
from an erstwhile
fifth.
Underlying this spurt
in economic activity
was the bed rock of a
transformed law and
order situation. In
February 2021, the
CM authored an
article in the Times of
India that said, “The
state has shrugged
off the tag of a
people have been
arrested under the
Gangster Act in the
last four years. On
the law and order
front, there has been
a 45% decline in
incidents of rape,
20% in cases of
murder, 66% in
dacoities and 40% in
cases of rioting.
To add to this the
rate of
unemployment in UP
has come down from
18 % to 4%.
The chief minister
wrote in a piece he
authored for the
Times of India in
March, “I am of the
firm belief that a
good work carried
out with good intent
and honesty in the
larger interest of
people is bound to
succeed”. This is a
resurgent UP, a
source of pride for
the nation. Crime is
becoming a hazard
for criminals, its
renunciation,
compelling.
